Terms and Conditions
The full terms and conditions governing your subscription to website design, development, and other internet-related services offered by Minitech IT Solutions Private Limited (the "Services") are set forth in this Services Agreement (the "Agreement"). In this Agreement, "Minitech IT Solutions" refers to Minitech IT Solutions Private Limited, and "Client", "you", or "your" refers to you. You declare that you have read the Agreement and that you abide by all of the rules presented on the Minitech IT Solutions site as well as its terms and conditions. The terms "Site" and "Minitech IT Solutions Site" as used in this Agreement relate to a World Wide Web site and, respectively, the Site at https://minitechitsolutions.com/ or any other succeeding Sites owned or administered by Minitech IT Solutions.
All website development and design services rendered to the Client by Minitech IT Solutions shall be subject to the terms and conditions set out below.
ACCEPTANCE
Clients don't have to sign anything to agree to these terms and conditions for them to be in effect. If a client takes a quote, they are considered to have understood the terms and to have agreed to all of these terms and conditions.
Please pay close attention to these terms and conditions. If you buy something from us or use our services, it means you've read and agreed to our terms and conditions.
ELIGIBILITY
The Sites are not to be used where prohibited. If you use the Sites and their features, you represent and warrant that:
- You are at least 18 years old;
- You do not violate any applicable laws or regulations; and
- You are responsible for all User Content posted and activity that occurs under your account (even when User Content is posted by others with accounts under your account).
CHARGES
The project quote that the Client gets by e-mail lists the prices for the services that Minitech IT Solutions will provide. The quoted price is good for 30 days. Minitech IT Solutions keeps the right to change or not give a quote after the 30 days are up.
Unless the Client agrees to something different, all website design services require an advance payment of at least fifty per cent (50%) of the total project quote before the work is given to the Client to look over. The final fifty per cent (50%) of the project quote total is due when the work is done before it is uploaded to the server or released.
CLIENT REVIEW
During the design stage and when the overall website development is finished, Minitech IT Solutions will give the Client a chance to examine the website's appearance and content. Unless the Client tells Minitech IT Solutions otherwise, within ten (10) days of the date the materials are made available to the Client, such materials will be taken to have been accepted and approved at the conclusion of the project.
CONTENT CONTROL AND TURNAROUND TIME
By the date indicated in the project proposal, or at the date agreed upon with the Client upon Minitech IT Solutions receiving initial payment, Minitech IT Solutions will install and publicly post or supply the Client's website, unless a delay is expressly requested by the Client and approved by Minitech IT Solutions.
In exchange, the Client undertakes to designate one person as the principal contact who will work with Minitech IT Solutions to advance the commission in a timely and satisfactory manner.
The Client will be required to supply website content, including text, photographs, movies, and sound files, throughout the project for Minitech IT Solutions.
PAYMENT
Before publishing the finished website live, but after completion, Minitech IT Solutions will issue invoices. The usual method of sending invoices is email, but the client has the option of receiving paper copies as well. Charges are payable right away.
ADDITIONAL EXPENSES
The client acknowledges that any additional costs incurred to complete the task will be covered by the client. Examples include buying unique fonts, stock photos, etc.
WEB BROWSERS
Every effort is made by Minitech IT Solutions to ensure that websites are made to be accessed by the majority of visitors. The most widely used modern browsers, such as Firefox, Internet Explorer, Google Chrome, etc., are supported by websites. Client acknowledges that Minitech IT Solutions cannot guarantee proper operation across all operating systems and browsers.
Minitech IT Solutions disclaims any liability for web pages that do not function properly in updated browsers that are provided to the Client after the website has been created and developed. As a result, Minitech IT Solutions reserves the right to provide a price for any work required to modify the website's design or code in order to make it compatible with newer browser versions.
TERMINATION
Any request by the client to end services must be made in writing and will take effect after being received. Service cancellation requests made over the phone will not be honored unless and until they are confirmed in writing. The client will get an invoice for the services done up until the first cancellation notice, which must be paid in full within thirty (30) days.
INDEMNITY
Only legal uses are permitted for all Minitech IT Solutions services. You consent to defend and hold harmless Minitech IT Solutions from any claims that your use of our service has injured you or any other party.
COPYRIGHT
The Client grants Minitech IT Solutions the right to publish and utilize any data, files, or graphic logos that the Client provides while keeping all copyrights therein. Any data or files that are protected by a third party's copyright must be used with the Client's consent and within the bounds of those rights. The Client further agrees to grant Minitech IT Solutions the necessary licenses and rights for the use of the same, as well as to defend Minitech IT Solutions against any legal actions stemming from the Client's carelessness or inability to get the necessary copyright permissions. The Client's assurance to Minitech IT Solutions that all necessary licences and authorities have been obtained shall be deemed to be included in any contract for website design and/or placement. It may be necessary to provide proof of authorizations and powers.
GENERAL
All prior statements, understandings, and agreements are superseded by these Terms & Conditions. The Client agrees to and accepts these Terms and Conditions by signing the following form or paying an advance charge. Accepting our terms and conditions by making a payment online.
GOVERNING LAW
The laws of India shall apply to this Agreement.
LIABILITY
By signing below, Minitech IT Solutions releases itself, its employees, and/or its agents from all liability for:
- Loss or damage brought on by any error; Loss or damage brought on by an omission;
- loss or harm brought on by a delay or error, whether brought on by carelessness or another factor during the creation of the website;
- loss or damage to client-supplied images for the website. It doesn't matter if the loss or damage is the result of negligence or something else.
- The amounts paid for the Services under this Agreement in respect of which the breach has occurred shall be the extent of Minitech IT Solutions's total responsibility to the Client with respect to any claim or breach of this Agreement, whether or not resulting from negligence.
SEVERABILITY
The remaining provisions of this Agreement shall not be affected, and the Agreement shall not be void for the sole reason that one or more of its sections are determined to be invalid, unlawful, or unenforceable. Such invalid, unlawful, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that is mutually acceptable and that most closely matches the parties' original intentions.
